Light turn on with brightness error

Hi, does anyone know what’s wrong with this:

I have this in several automations and have just discovered an issue, if I send this command via dev tools it always works, however if the lights are in the off state when running this it still works but logs an error…

websocket_api script: Error executing script. Unexpected error for call_service at pos 1: 201: parameter, bri, is not modifiable. Device is set to off.

Can post full trace back if required.
If the lights are already on then no error, if I remove the brightness value then no error also.

It does not make a lot of sense to me at present as why would it not be a valid request to turn on with a set brightness just because they are already off?

I would not be worried about it too much as the function still works correctly but due to the error it’s ceasing the automations it’s in and therefore the rest of the automation fails to action from this point.
