Put a condition in your automation.
- condition: state
entity_id: switch.tv_ir_switch
state: 'on'
So the action will not fire if the switch is off.
That dit the strick, made an script from because i use it in a few automations.

Ik looks so easy right now 
I’ve go a “USB - Service Only” port on the tv.
